I personally don't think you can have a B visa if you don't work or study in Canada. About a 10-year B visa, you are totally out of control. You may be given a 6-month, 1-year, 3-year, 5-year, or 10-year. Only the offical who takes your case knows. I don't know the immgration things in China. If you are lucky, you can get one. Presumably it is a short one. But long enough for you to come to US first, and marry here.

You can marry inside or outside US. The difference is that if you apply outside US, you will have to wait for an immgration visa number to get in US. If you apply in US, you can wait in US.

You may want to apply for a B visa after you get married. I remember I heard that normally the immigration will consider you have strong intentions to immigrate to US, because you married to a US PR, and you want to apply for a visa for pleasure. This is obvious. (I could be wrong)

By the way, if you have a B visa, and you apply for an immigration visa, your B visa automatically expires. The immgration officers will check your status in their system. Even you present a B visa, they find you are applying for an immgration visa, then they won't look at B visa at all. Besides, you lie to the immigration officers.

2) 7 年, 太长了.可否我们先不申请, 等到他两年之后入籍后, 然后再申请团聚,

It is up to you, whenever you are ready. But this assumption is based on you can legally stay in US for 2 or 3 years by the time he got his citizenship or you can wait either in China or Canada. Normally B visa can make you stay in US at most for 6 months for one time. If you have a multiple-entry B visa, you can get out at the time of 6 months, then you reenter.

Again, if you don't have a good status in Canada, noone can issue you a multi-entry B visa. Besides nobody knows how long this visa can cover. If you get a B visa in China, it is even worse, because normally immgration won't issue a multi-entry visa to a Chinese. (Again, I could be wrong)

If you apply after he becomes a citizen, please prepare 2.5 years for an PR approval. So in this case, you are talking about 2/3 year+2.5 years.

3)如果我持B1/B2 签证到美国, 然后马上在美国结婚, 不回来了, 可不可以在美国境内转身份? PR Pending时, 可以在美国工作吗?

As I said above, if you are holding a B visa AND you don't apply for an immigration visa, you can not stay in US more than 6 months for one time.

Of course you can. When you apply for an immigration visa, you can submit another document to apply for working authorization. It will be issued within 3, or 4 months, after that, you can work legally. This document also can be renewed at a year basis.

It will be a long battle for you. We all know that some people are lucky, some people are extremely lucky, and the others are just regular. If you love him, and will like to be with him for both of your lives, it should be fine. Only the time and money issues. But, if you manage well, it should not be tough.       本文发表在 rolia.net 枫下论坛First of all, a canadian PR means nothing to US immigration. It could be even worse when you apply a VISA in Canada because you have the immgration intentions. Your immigration to Canada is the obvious evident.(not my oppinion, I heard from the immigration officials)

      1. If you came to Canada, you can possibly have a B VISA at least after half a year, supported by an employment or school. Then you can go to US, marry there and wait in US. You can apply for travel document to reenter US, and this document can be renewed every year. If I am correct, it will take you about a few years to wait for approval of a GC, could be up to 7 years because your bf's status: PR.

      2. If you apply for a B VISA in China, and you have a good shape, you can get a VISA in China. Then go to US, marry there, wait for a GC. I guess the same thing, up to 7 years.

      3. Another case will be that you marry in China, and apply for a GC in China. I don't know this case. You may research online.

      Refer to this webpage http://www.uscis.gov. There is a status online, you can check the process there, and it lists the processing cases for the receipt dates.

          • Thank you so much. We decide wait till he becomes a citizen. Aong this certain period, I will move to Canada to close him, then we marry and deliver baby in CA as well.
            Because he is near 40 right now. Sigh, he has to fly back and forth but this is only way to make sure we can be together. Damn US!

            • My friend holds GC, he cannot get married with girl living in China, cause she cannot get GC and cannot have a definite visa in states. I learned all of this from his experience.
              In my case, i always use B visa to meet my bf in States, each time i cannot stay exceeding 6 months.Not sure whether you can enter states, since to marry with GC holder has serious immigration trends in the immigration office's eyes.
              • Of course you can apply for an immigration visa. Anybody can if the he/she is in US, and he/she is a spouse of either a citizen and PR. The only difference is the time.
