Unhappy with your MPAC assessment? Just fill a complaint. Details inside.

note: As a result of public complaint, in 2006 the Office of the Ombudsman of Ontario issued a Report critical of MPAC's policies and procedures and property assessments were frozen until January 2008.


I got most the info from the following website. I added some new info since the rules have been changed that it is more easier for homeowners to file the complaint now. The key points from the Ombudsman of Ontario report (2006) is that it is now MPAC's responsibility to prove its assessment is correct. Before homeowners have to collect a lot of info in order to prove MPAC's assessments were wrong.

HOW?

1st stage:
- sending MPAC a "Request for Reconsideration." (RfR) before March 31st.

2nd stage:
- You have 90 days after MPAC has notified you of its decision on you of its decision to file an appeal to ARB. ( It's an independent tribunal of the Ontario Ministry of the Attorney General.

- MPAC has to prove the accuracy of the assessed value. MPAC will present comparable properties an evidence and share the info with you.

Tips:
1. Ask MPAC to confirm how the property was assessed and what comparables MPAC used. MPAC's Property Comparison Report is free but most homeowners fail to ask for this report and only end up getting it on the day of the hearing at the Assessment Review Board. At the hearing the owner has very little time to review MPAC's report and the owner is at a great disadvantage conducting the hearing.

2. Review all the sales of similar homes on Property Comparison Report. Look at the range of sales: the high and low; look at the average (take all the sale prices and total them up and then divide by the number of sales) and median (the middle sale within the range).
important: you should look at the sale price, not the assessment value

    • Step 1, emailed and faxed "Request for Comparable Report". The customer service prep said that they will send 6 comparable properties info to me on the first come first serve bases. Now wait and see.
    • Thanks for sharing. We'll fill a complaint as well . The MPAC assessment is just ridicious.
